
The Nigerian Electricity Regulatory Commission, NERC, has transferred regulatory oversight of Akwa Ibom State’s electricity market to the Akwa Ibom State Electricity Regulatory Commission, AKSERC.
The action follows the amended Constitution and the Electricity Act 2023, which allow states to regulate intrastate electricity markets after formal notification to NERC. NERC will however retain oversight of inter-state and international power operations.
Under the transfer order, Port Harcourt Electricity Distribution Plc, PHEDC, has been directed to incorporate a subsidiary, PHEDC SubCo, to handle intrastate supply and distribution in Akwa Ibom.
PHEDC has 60 days from August 18th, 2026, to complete the incorporation. The new subsidiary must also apply for and obtain a licence to operate from AKSERC.
NERC said all processes and transfers under the order must be concluded by February 17th, 2027.
The Commission noted that the transfer is part of efforts to decentralize power sector regulation and give states more control over electricity within their territories.
